Please read these Terms and Conditions (“Terms”) carefully before using the website, creating an account, or placing an order. By accessing smart-residence.ro (including subdomains and test environments operated by us), creating a customer account, ticking the acceptance box at registration, or completing a purchase, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any other policies expressly referenced on the site.
If you do not agree, do not use the website or place orders through it.
Informational note: This text is drafted to inform customers and protect the operator in line with Romanian and EU e-commerce and consumer-protection rules. 1. General provisions
1.1. These Terms govern access to and use of the website, the contractual relationship between the operator and customers regarding distance sales of products (premium appliances, accessories and related services), and the rights and obligations of the parties.
1.2. These Terms form the general contractual framework. Commercial offers, order confirmations, invoices, warranty certificates and delivery documents supplement the relationship where they do not conflict with mandatory law.
1.3. If any provision is held invalid, the remaining provisions remain in effect.
1.4. We may refuse orders, limit quantities, or restrict access in case of breach of these Terms, suspected fraud, abuse, or legal requirements.
2. Definitions
Operator / we / Smart Residence, MDS SMART CONSULTING S.R.L., the legal entity operating smart-residence.ro; Customer / you, any person accessing the site, creating an account, or placing an order; Consumer, a natural person acting outside their trade or profession; Professional, a person acting in a commercial or professional capacity; Website, smart-residence.ro; Products, goods sold online; Order, a firm purchase request submitted electronically; Contract, the distance sales contract; Related services, delivery, installation, mounting, consulting, commissioning; Content, materials on the site; Personal data, data within the meaning of GDPR.
3. Operator and contact
The online store is operated by MDS SMART CONSULTING S.R.L., tax ID CUI/CIF 40005082, company registration no. J20/1800/2018, registered office at Str. Barna no. 7, Moșnița Nouă, Timiș County, Romania, under the commercial name Smart Residence.
The customer service address is the one displayed in the website contact section and may differ from the company's registered office.

4. Scope
These Terms apply to orders placed through the site from Romania unless otherwise agreed in writing (B2B framework contracts, special projects). For consumers, mandatory Romanian and EU consumer-protection rules prevail over less favourable contractual clauses, including Government Emergency Ordinance (GEO) no. 34/2014 on consumer rights in contracts with professionals.
For B2B customers (legal entities/professionals), the parties may agree through offer, confirmed order, framework agreement or commercial annex on terms different from standard consumer terms, including specific delivery/performance timelines, different warranty schemes, negotiated liability limitations, and exclusion of the 14-day withdrawal right to the extent permitted by law.
5. Use of the website
You must use the site lawfully, without compromising security, without unauthorised scraping, without malware, and without impersonation. Product descriptions and images are indicative; check essential specifications (built-in dimensions, energy class, compatibility with the manufacturer’s apps and digital ecosystems, included accessories) before ordering. Prices and availability may change; a confirmed order is governed by the order chapter.
6. Customer account
Account creation is optional for browsing but useful for order history, favourites, and comparisons. You must provide accurate data and keep your password confidential. Passwords are stored encrypted (hashed). We may suspend accounts for breach, false data, fraud, or non-payment. By registering you accept these Terms and the Privacy Policy.
7. Product information
Products are generally new goods for normal use per the manufacturer’s documentation. Brand names belong to their owners. Connected features (Wi-Fi, mobile apps, notifications), compatibility with the manufacturer’s digital ecosystems and, where applicable, voice assistants depend on your infrastructure, manufacturer updates, and third-party services; we do not guarantee features controlled exclusively by third parties.
Intelligent features of Miele products (such as the Miele app, WiFi connectivity and the manufacturer’s cloud services) depend on infrastructure and services provided by the manufacturer and may change independently of the operator.
Incorrect installation may void the manufacturer warranty.
8. Orders and contract formation
Submitting an order is an offer to contract. The automatic order-registration message (email/SMS/account notice) is informational only and does not by itself constitute final acceptance of the order.
The contract is formed when we expressly confirm the order (email, phone confirmation, or account confirmation), unless we inform you that the product is unavailable or we do not accept the order (e.g. obvious pricing/technical error, fraud suspicion, legal restriction).
Contractual documentation may include, where applicable: order confirmation, tax invoice, warranty certificate, conformity certificate (if applicable), delivery/transport document, and any commercial annex for installation services.
Pre-contractual information required by law is provided via the site and these Terms.
Some products may have extended delivery times depending on manufacturer, importer or international logistics availability, especially for made-to-order items, special colours/configurations or built-in premium models.
9. Prices, VAT and promotions
Prices are usually in RON and include VAT unless stated otherwise. Additional costs (delivery, installation) are shown before checkout. We may correct obvious errors before confirmation and refund if payment was already made. Promotions are subject to stated conditions.
10. Payment
Accepted methods are shown at checkout. Card payments are processed by authorised intermediaries; we do not store full card details. We may request advance payment for certain orders. Non-payment or unjustified refusal of delivery may lead to cancellation and recovery of costs within legal limits.
11. Delivery, installation and mounting
Delivery times are estimates and may vary depending on stock, supplier availability, destination, peak periods or force majeure. Some products may have extended lead times for the same reasons.
Delivery is to the address you provide under agreed conditions. Before delivery you must verify safe access: door widths, lift dimensions and load capacity, stairwells and any parking or time restrictions. For bulky appliances (fridge-freezers, wine coolers, Side-by-Side units etc.), lack of safe access may require rescheduling, extra charges or inability to complete delivery.
Related services apply only if ordered and confirmed. For certain built-in products, you are responsible for ensuring compliant cabinetry and utilities (niche dimensions, connections, ventilation, power supply) before installation. Installation on non-compliant fittings may affect performance and the manufacturer warranty.
Risk passes on handover unless otherwise required by law. Failure to accept delivery may incur rescheduling fees or cancellation.
12. Receipt of goods
Check packaging and product identity on receipt; note visible damage to the carrier where possible. Report issues promptly in writing with photos.
Unsealing packaging and commissioning the product may affect the right of withdrawal for sealed goods that cannot be returned for health or hygiene reasons once the seal has been broken after delivery (under art. 16(c) of GEO no. 34/2014, as applicable).
13. Legal conformity guarantee
Consumers benefit from the legal conformity regime under applicable Romanian law (including Government Emergency Ordinance no. 140/2021). In case of lack of conformity you may request repair, replacement, price reduction, or contract termination within legal limits, subject to proof of purchase and defect description.
14. Manufacturer commercial warranty
Many products include a manufacturer warranty per the warranty certificate. It is additional to the legal guarantee and does not replace it. Activation conditions (registration, authorised installation) are your responsibility.
15. Right of withdrawal (consumers)
If you are a consumer and the contract was concluded at a distance, you may withdraw without giving reasons within 14 calendar days from the day you or a third party you designate (other than the carrier) acquire physical possession of the goods.
Notify us clearly (e.g. email to [email protected]) before the deadline. Refunds will be made within legal time limits once goods are returned or dispatch is proven. We refund the product price and standard delivery. We may withhold the refund until we receive the goods back or you provide proof of dispatch, whichever occurs first.
We do not refund additional delivery surcharges (e.g. express delivery, scheduled time-slot delivery, special handling) nor already-performed services (e.g. installation/mounting), except where mandatory law requires otherwise.
You are liable for diminished value beyond what is necessary to examine the goods. Return shipping costs are generally yours unless we agree otherwise or law requires otherwise.
Exceptions apply under art. 16 of GEO no. 34/2014, including custom-made goods, sealed hygiene/health goods unsealed after delivery, inseparable mixed goods, and certain digital content where performance began with your express consent. Unsealing/installing sealed appliances may limit withdrawal.
16. Returns, exchanges and complaints
Warranty returns are separate from contractual withdrawal. Return goods in original packaging with accessories where possible. We do not accept returns of misused or unauthorisedly modified products without proof of purchase from us. Complaints are handled within reasonable timeframes.
17. Personal data protection
We process data for accounts, orders, delivery, invoicing, marketing (with consent where required), legal obligations, and legitimate interests. Full details are in our Privacy Policy on the site (purposes, legal bases, retention, rights, ANSPDCP complaints). Cookies may be used as described there or in a separate cookie policy.
Non-essential cookies (e.g. traffic analytics, campaign performance measurement, remarketing) are activated only on the basis of explicit user consent where legally required. The consent banner provides both accept and refuse options, and the selected option is stored technically to avoid repeated prompts.
At present, Google Analytics and Meta Pixel are not used on this website. If similar tools are enabled in the future, they will be listed in the privacy/cookie policy together with purpose, legal basis, retention details, and available consent-withdrawal mechanisms.
18. Intellectual property
Site content is protected by copyright and other rights. Copying or commercial exploitation without written consent is prohibited except as permitted by law. Third-party trademarks belong to their owners.
19. Limitation of liability
To the extent permitted by law, we are not liable for indirect losses, loss of profit, loss of data, or business interruption. Our total liability for an order is limited to the amount actually paid for that order’s products and services, except where law does not allow limitation (e.g. death or personal injury caused by our negligence).
Product images are for information purposes. The manufacturer may change certain design details, included accessories, software interface or technical revisions without prior notice, without affecting the essential functionality ordered. Differences in colour shade, texture, labels or product version may occur between online presentation and delivered goods, without automatically constituting non-conformity where essential ordered specifications are met.
Where justified (supplier unavailability, generation/model change, product withdrawal), we may propose a technically/functional equivalent or superior replacement. If the customer does not accept, the order may be cancelled with refund of amounts paid, without additional damages beyond mandatory legal rights.
We are not liable for temporary website or service unavailability caused by factors outside our reasonable control, including internet outages, network congestion, third-party infrastructure incidents, cloud-service outages, or technical-provider maintenance.
We are not liable for defects caused by power fluctuations, non-compliant electrical supply, improper grounding, overvoltage, electrical discharge, unsuitable installation, or operation outside manufacturer-recommended parameters.
We are not liable for effects of modifications, interventions, or configurations performed by unauthorised third parties (including firmware/software changes, forced compatibility with digital ecosystems not certified by the manufacturer, security-parameter changes, or unauthorised installation/repair).
20. Force majeure
Neither party is liable for failure caused by events beyond reasonable control (disasters, war, authority acts, major utility failures, epidemics, essential third-party strikes, severe logistics disruption).
21. Alternative dispute resolution
Consumers may contact ANPC (Romania), www.anpc.ro, and use the EU ODR platform: https://ec.europa.eu/consumers/odr. We encourage amicable resolution at [email protected] first.
22. Applicable law and jurisdiction
These Terms are governed by Romanian law. For consumers, court jurisdiction follows mandatory consumer rules. For disputes between professionals, courts in Timișoara may have jurisdiction unless law provides otherwise.
23. Changes to the Terms
We may update these Terms for legal, technical, or commercial reasons. The version published at use or order confirmation applies. Check this page periodically.
